Peters & Peters act in EAW case before the EU Court of Justice
Peters & Peters is acting for the CEO of a multinational company in preliminary reference proceedings heard before the Court of Justice of the European Union on 28 February 2018.
The preliminary reference relates to the interpretation of the EU legal framework on the European Arrest Warrant (EAW) and the surrender procedures between EU Member States. In particular, it focuses on the proper application by Member States of the principle of ne bis in idem, according to which no person shall be prosecuted twice for the same offence. A further question concerns the obligations of Member States to adopt a decision on additional EAWs issued in relation to the same individual, for the same offence and in the context of the same criminal proceedings.
