Business engagement in environmental sustainability and social responsibility has come into sharp focus since the Paris Agreement in 2015 (now commonly referred to as “Environmental, Social, and Governance”, or “ESG”, for short). While ESG as a concept has existed for almost a decade, the prominence and development of “ESG civil litigation” and “ESG criminal enforcement” — both of which seek to hold corporate actors and directors to account for failures in the ESG sphere — is more recent.

Many online resources chart the rise in ESG civil litigation; but few examine criminal and regulatory enforcement in this space. Our tracker does just that, focussing on key matters in prominent jurisdictions in the past few years.
